SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-400/93-20)
This refers to the inspection conducted by W. W. Stansberry of this office on September 13-17, 1993. The inspection included a review of activities authorized for your Shearon Harris facility. At the conclusion of the inspection, the findings were discussed with those members of your staff

identified in the enclosed report.
Areas examined during the inspection are identified in the report.
Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progress.
Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice). The violations are of concern because both violations involve personnel who are not part of the security organization and were not fulfilling their security responsibilities. One violation is a repeat of a

violation cited previously and the second is a failure to provide operational support functions to the security program.
In addition, the enclosed Inspection Report identifies activities that violated NRC requirements that will not be subject to enforcement action because the licensee's efforts in identifying and correcting the violations met the criteria specified in i
Section VII.B. of the Enforcement Policy.
l The first violation described in the enclosed Notice is similar to a noncited violation contained in the Inspection Report No. 50-400/92-14 sent to you by our letter dated July 23, 1992.
Recurring violations are of particular concern because the NRC expects licensees to learn from their past failures and to take effective corrective actions.
In your response to the enclosed-Notice, you should document the specific actions taken and any additional actions you plan to prevent recurrence.
