1 AND 2 DOCKET NOS. 50-400 AND 50-401 DOCKETING OF FINAL SAFETY ANALYSIS REPORT AND ENVIRONMENTAL REPORT OPERATING LICENSE STAGE

Dear Mr. Denton:

By application dated June 3, 1971, Carolina Power

& Light Company (CP&L) applied for Construction Permits and 40-year Operating Licenses pursuant to Section 103 of the Atomic Energy Act of 1954 as

amended, to construct and operate the Shearon Harris Nuclear Power Plant (SHNPP) located at New Hill, North Carolina.

On January 27,

1978, Construction Permits for these units were issued.

By letter dated June 26,

1980, CP&L submitted an amended Application for Operating License (OL) accompanied by copies of the Final Safety Analysis Report (FSAR) and the Environmental Report - Operating License Stage (ER-OL).

In accordance with Mr. D.

G. Eisenhut's letter of November 25, 1981 concerning the Acceptance Review of CP&L's Application for OL for

SHNPP, CP&L hereby submits the following information for the NRC's detailed review, and in support of the issuance of an OL for each unit:

Three (3) signed originals of the amended Application, Fifteen (15) copies of the General Information Section, Forty (40) copies of the FSAR, and Forty-one (41) copies of the ER-OL Distribution of the above documents in accordance with Enclosure 1 of the November 25, 1981 letter will be complete within 10 days after docketing.

8112220531 811218 PDR ADOCK 05000400 CP&L will amend the SHNPP FSAR and ER-OL within three months of tbe docketing date to address tka additional information requested in pD Enclosures 2 and 3 to the November 25, 1981 letter.

1980, CP&L announced the revision of the construction schedule for Unit 1 of SHNPP.

The commercial operation date was revised from March to September of 1985.

Additionally, on December 16,'981, CP&L announced the cancellation of Units 3 and 4, and a revised operation date for Unit 2.

Therefore, the schedule for the SHNPP units is as follows:

Unit Fuel Load Commercial 0 eration December 1,

1984 June 1, 1988 September 1,

1985 March 1, 1989 Due to the interval between commercial operation of Unit 1 and Unit 2, it is requested that only Unit 1 be considered for an operating license at this time.

Consistent with this, the Federal Register notice pub-lished pursuant to 10CFR 2.105 should limit the opportunity for a hear'ing to consideration of the Unit 1 operating license.

A new proceeding would then be required to consider the Unit 2 operating license, and would be instituted closer to the in-service date for that unit.
