Waterford 3 SES Docket No. 50-382 Compliance with 10 CFR 73.21

Dear Mr. Tedesco:

The Federal Register on October 22, 1981 announced a final rule regarding protection of unclassified safeguards information. Included in this cas notice that applicants for a license to operate a production or utilization facility, who prepare a physical security plan, a safeguards contingency plan, or a guard qualification and training plan, shall protect the plans and other related safeguards information against unauthorized disclosure in accordance with the requirements of 10 CFR 73.21, as appropriate. NUREG-0794 provides guidance in this respect. This provision becomes effective on January 20, 1982.

The purpose of this letter is to request for LP&L an extension of the effective date.

We expect to fully comply with the new rule (and related guidance spelled out in NUREG-0794) no later than April 30, 1982. However, it should be noted that in the interim, Safeguards Information will be stored in non-GSA approved cabinets located in controlled access areas. In addition, procedures to meet the full requirements of the rule are being developed, as well as the training necessary to implement these procedures.
