LP&L RESPONSE TO THE NOTICE'0F VIOLATION IDENTIFIED IN APPENDIX A 0F INSPECTION REPORT 90-01 f

--VIOLATION NO.- 9001-01 Failure to Ensure that Operator License Conditions were met for' Licensed Operators on-Duty s

Technical Specification 6.2.2.b requires at least.one. licensed operator to -

be in the control room when fuel is in the reactor. In addition, while the reactor is.in Mode'1, 2, 3,_or 4, at least one licensed senior operator shall be in the control room.

10CFR55.53(1) requires operator. licensees to have a biennial medical' examination as a condition of their license.

Contrary to the above, on' January 16 and 17,1990, a senior operator was on duty as shif t supervisor while the reactor was in Mode 1, without having met the.above-medical' examination. license condition since September 23, 1989.-- In addition, at least'nine other operator / senior operators stood watches for a number of days in the past 2 years without having met the

. biennial medical examination license condition.

This is a Severity Level IV violation.

~ RESPONSE I (1): Reason for the Violation LP&L admits this violation and believes that the root cause was the lacklof a formal method to ensure'that the licensing condition imposed- .4

-by110CFR55.53(i), which requires biennial medical examinations for

~ licensed operators, was successfully tracked.and executed. A number-of biennial medical examinations.for reactor and seniorireactor-

. operators were not' conducted by their individual due dates,=and a portion of these operators stood watch in the period after which their i medical exams were overdue. There were a minimum'of three departments at Waterford.3 sharing the responsibility for the execution of medical examination license requirements. However, a method did'not exist to J ensure that' operator medical examinations were conducted within the timeframe of 10CFR55.53(i). Personnel error was a contributing factor, and resulted in the scheduling of an operator for control room g duty who had not met the biennial medical exam licensing condition.

W3P90-0269-Page 2_of.3 The problem was first discovered when LP&L was notified by Region IV that-the medical =information reports on two licensed operators were B overdue.__ In response to this notification, LP&L began an initial investigation to-identify the status of operator-medical examination-N . requirements in accordance with the license condition defined by 10CFR55.53(1).- The investigation of operators' records identified that twelve licensed operators were' delinquent as to'their biennial medical examinations, and further, that a number of these operators _

had served control room duties during the delinquent period. As a result of this investigation, a quality notice was issued to identify _;

root cause and:1nitiate corrective action.

While the quality notice was still under consideration, LP&L began the process of expediting medical exams for all delinquent operators.

Eleven of the twelve subject: operators were given' medical examinations in accordance with 10CFR55.53(1). When the NRC inspectors reviewed a sampling of operator' records on January 17, 1990, they identified that the Shift Supervisor currently on duty (January 16 and 17) had not received his biennial medical exam. LP&L had mistakenly. scheduled a delinquent operator for duty, and this situation resulted in the subject violation. Upon notification of the violation, the Shift

. Supervisor was relieved from duty pending completion of a medical exam. The operator's medical examination revealed no disqualifying conditions which would have compromised plant safety or public health'.

(2) Corrective Steps That Have Been Taken and the'Results Achieved The Qual' i ty Notice generated on January 5,1990 was issued to identify ')

'a condition' adverse to quality, and ensure proper corrective action.

A 100 percent Quality Assurance review of licensed operator medical examination records was conducted. The Quality Notice listed the individual operators whose medical examinations were delinquent. This F list _was used by LP&L to expedite the overdue medical examinations, in an effortrto promptly correct the immediate concerns, as well as the overall deficiencies.

Following review of the Quality Notice, LP&L implemented a system to track the types and due dates of-required medical examinations of  !

licensed operators, in accordance with the license condition of j 10CFR55.53(i). 'This system is also used to prompt those individuals l

.due for medical examinations, and identify any delinquent medical examinations affecting an operator's license. l (3) Corrective Steps Which Will be Taken to Avoid Further Violations

'As corrective action and alleviation of the root cause and contributing factors, LP&L shall evaluate the need for a procedure and/or formal method to comply with the medical examination requirements of 10CFR55.53(1).
