This refers to your letter dated February 24, 1988, regarding Reactor Water Cleanup (RWCU) Isolation Actuation Instrumentation. You requested regional discretionary enforcement regarding your proposed course of action to bypass the Non-Regenerative Heat Exchanger (NRHX) Outlet Temperature - High signal when it seals in the RWCU isolation, pending implementation of a Technical Specification change.

Subsequently, you submitted your application for amendment dated March 10, 1988, as supplemented by your letter dated March 10, 1988. The amendment would revise the Technical Specifications to delete the NRHX Outlet i'emperature - High signal from the listing of RWCU system isolation signals. NRC's Office of Nuclear Reactor Regulation is currently reviewing this amendment request.

Discretionary enforcement is a vehicle for the Regional Administrator to use in certain limited circumstances in which a license amendment would not be appropriate. The situation must also not have been reasonably foreseen by the licensee and timeliness of NRC action would need to be of the essence to preclude imposition of a transient. In this case we concluded that your request did not meet the criteria for granting discretionary enforcement.
