Mr. D. R. Gipson
Senior Vice President -
. Nuclear Generation -
The Detroit Edison Company.

SUBJECT:-
NRC INSPECTION REPORT 50-341/99017(DRS)
Dear Mr. Gipson:
This letter refers to the special inspection conducted on September 27,1999, at the Detroit
Edison Company's (DECO) Fermi 2 nuclear plant. The inspection was performed in response
to information reported to the U.S. Nuclear Regulatory Commission (NRC) on September 22,
1999, by a representative of DECO that a loaded handgun had been found within the protected
area of the Fermi 2 facility. As a result of this inspection, one apparent violation of NRC
requirements was identified and is being considered for escalated enforcement action in
accordance with the " General Statement of Policy and Procedure for NRC Enforcement
Actions" (Enforcement Policy), NUREG-1600.
As a result of the NRC inspection, it may not be necessary to conduct a predecisional
enforcement conference in order to enable the NRC to make an enforcement decision. The
. NRC recognizes that DECO identified the violation and immediately notified the NRC. The NRC
also recognizes that prompt and effective corrective actions were taken to prevent recurrence
of the violation. The corrective actions included, but are not limited to: (1) discussing the
incident with all security personnel; (2) training all security officers on vehicle search procedures
and activities; (3) establishing a review team to determine the root cause of the incident; and
(4) obtaining investigative assistance from law enforcement agencies. Therefore, a civil penalty
or an order may not be warranted. . The final decision will be based on DECO's confirmation on
. the license docket that the corrective actions previously described to the NRC staff have been
L or are being taken. You are required to inform the NRC if the above description does not
accurately reflect the corrective actions or your position.
Before the NRC makes its enforcement decision, we are providing you an opportunity to either:
(1) provide a written response to the apparent violation, discussed above, within 30 days of the
~ date of this letter, or (2) request a predecisional enforcement conference. If a conference is
held, it will be open for public observation. Please contact Mr. James R. Creed, at telephone
k,'
i number (630) 829-9857 within seven days of the date of this letter to notify the NRC of your
intended response.
