ISSUANCE OF FULL-TERM OPERATING LICENSE DPR-21 Re: Millstone Nuclear Power Station, Unit 1 In response to your application, dated September 1,1972, for conversion of your provisional operating license to a full-term license, the Commission has issued the enclosed Facility Operating License No. DPR-21 to operate the Millstone Nuclear Power Station, Unit 1, at steady-state reactor core power levels not in excess'of 2011 Megawatts (thermal), in accordance with the provisions of the license and the technical specifications.

Millstone Nuclear Power Station, Unit 1, has operated since October 7,1970 under Provisional Operating License No. DPR-21. Facility Operating License No. DPR-21 supersedes Provisional Operating License No. DPR-21 in its entirety.

All orders issued under the Prov.isional Operating License remain in effect under Facility Operating License No. DPR-21.

We are reformatting the license, as n'ecessary, to achieve consistency with the language used in contemporary licenses. Certain requirements have been deleted from the license itself because they are already in the technical specifications or they are no longer-applicable. The license changes have been agreed to by your staff.

There were certain exemptions granted under the provisional license and those remain in effect. Those exemptions have been included in section 2.0 of the enclosed license.

We have included a revised license condition for the fire protection program (2.C.(3)) that incorporates the standard presented in Generic Letter 86-10, even though implementation is not yet complete. We recognize that, pending the completion of implementation, you will not have explicit procedures for determining whether plant modifications affect the ability to achieve and maintain a safe shutdown in the event of a fire, nor will you update the FSAR (in accordance with the provisions of the schedular exemption from 10 CFR 50.71). e j Mr. John F. Opeka associated with design changes reviewed under 10 CFR 50.59 to determine whether any design changes significantly decrease the level of fire protection and submit letter reports annually to describe any changes in the fire protection program.

The' technical specifications contained in Appendix A are being reissued in their entirety incorporating all applicable changes through Amendment 111. The numbering system for future amendments-to the license and technical specification changes for the new Facility Operating License No. DPR-21 will begin with number one (1).

The licensee entered into Indemnity Agreement No. B-39 on May 9, 1969, which remains in effect.

The staff's safety evaluation supporting issuance of the full-term operating license has been issued as NUREG-1143 (October 1985) and NUREG-1143,

. Supplement No. 1 (August 1986). In an evaluation _ dated December 17, 1984, as noticed in the FEDERAL REGISTER on December 26, 1984, the staff concluded that a supplement to the Final Environmental Statement, issued in June 1973, was not necessary.

A copy of the Notice being forwarded to the FEDERAL REGISTER for publication is also enclosed.
