Nested, in response to NRC Generic Letter 90-05, relief from ASME Boiler and Pressure Vessel Code Section XI requirements pursuant to 10 CFR 50.55a(g)(6)(1). The particular request related to a leak in the servico water piping and request for relief for temporary noncode repair in order to continue operation.

During my recent visit to Millstone 2, I observed the particular leak in the service water system and noted that there was in place a stopgap measure to  ;

limit the leakage from the pipe. We have determined that, stopgap measures to limit leakage in Class 3 piping do not require NRC approval as long as the structural integrity is not affected and the stopgap measure is reve siole, that is, the flawed piping can be returned to the as-found flawed condition.

We understand that you have determined there is adequate structural integrity in the flawed piping in accordance with the criteria of Generic Letter 90-05.

Also, since you intend to repair the flawed piping by replacing it with new i piping during the refueling shutdown beginning September 15, 1990, we do not see the need for formal relief.
