27, 1990, I sent you a ' setter acknowledging receipt of your letter dated August 22, 1990, and your check for $50,000 in payment for the civil penalties proposed by the NRC in a letter dated July 23, 1990.

I also indicated that your corrective actions were under review and would be examined during future inspections. We have completed our review of your proposed corrective actions and your response.

We agree with your statement that the corrective actions taken after this most recent event were prompt and extensive, and for this reason we mitigated the civil penalty by 50%. However we maintain that this mitigation was appropriately offset by the series,of recent events involving transportation violations at Millstone which, in itself, would warrant an increase in that penalty. Therefore, on balance, the amount of the penalty will remain as stated in the Notice of Violation and Proposed Imposition of Civil Penalty issued on July 23, 1990. The implementation of your corrective actions will be examined during future inspections.

In your response, you indicated that the specific event that resulted in the l

civil penalty had generic implications and you believed that issuance of a formal notification by the NRC to all licensees would be prudent. We are currently evaluating your request, and are considering.the drafting and issuance of an Information Notice. Notwithstanding our final decision on the i

issuance of an Information Notice it remains clear to the NRC that the root cause of this violation was a failure to verify the adequacy of your procedure l

for dewatering and drying the contents of the cask against the procedures contained in the Safety Analysis Report for the cask. The revised procedures that you discussed in your response will be examined during future inspections.
