Dear Mr. Cullen:

j in response to your petition submitted pursuant to 10 CFR 2.206 to the U.S. Nuclear Regulatory Commission (NRC) on April 14,1999, the NRC solicited support from the Federal Emergency Management Agency (FEMA) to ensure that an appropriate response to the enhancements you identified to the offsite emergency preparedness in the event of a radiological emergency at the Millstone station is developed. The enclosed June 4,1999, letter to FEMA from the NRC provides the NRC's formal request for FEMA to assist in the NRC's evaluation in the areas related to the adequacy of emergency planning for Fishers Island, New York. As you will note in the enclosed letter, the NRC requested that FEMA provide its evaluation in this area by August 16,1999. Provided FEMA is able to complete its evaluation by this date, the NRC will ,

be in a good position to provide you with its final Director's Decision with regards to offsite l emergency preparedness around the Millstone station by the middle of September 1999.  ;

Based on information in a newspaper from the area near Millstone, the NRC is aware of concerns you apparently have with our response to your request for immediate action provided in our acknowledgment letter dated May 14,1999. In the acknowledgment letter, the NRC provided you with its decision regarding your request to immediately suspend the operating licenses (shutdown the units) for both Millstone Units 2 and 3, along with information supporting NRC's decision. The information available to the NRC included not only our own analysis, but information evaluated and provided by FEMA as well. Both FEMA and the NRC reached their conclusions based on the available factual information, as well as practical exercises that demonstrated the feasibility of the emergency response plans for the Millstone site. The NRC evaluated the infonnation that you provided in your 10 CFR 2.206 petitions, and determined that there was no additional information or facts that on the surface bring into question the findings of either FEMA or the NRC on the adequacy of offsite emergency preparedness for the Millstone station. Thus, the NRC had no basis to support your request to immediately suspend the operating licenses for Millstone IJnits 2 and 3 as requested in your petition.

Despite this initial determination, the NRC takes your concerns seriously. With this in mind, the staff of the NRC, with the assistance of the staff of FEMA, are evaluating the information provided in your petition requests to determine whether enhancements could be made to the offsite emergency preparedness for Millstone station. With a timely response from FEMA, and the completion of our own evaluation, the NRC expects to provide you with a full response and f Director's Decision regarding your petition by about the middle of September 1999. '
