Dear Mr. Grimsley:

This is a request under the Freedcm of Information Act as amended (5 U.S.C. 552).

The enclosed article, published by Gambit in its March 19, 1983 issue, reports some of the contents and conclusions contained in NRC Inspection Report 50-382/82-14, dated December 6,1982. The report, as you can see, deals with the failure of certain elements of the quality assurance program overseen by Louisiana Power and Light Company at its Waterford III nuclear power plant. Although the report itself is dated in December, the actual inspections it is based on occurred in May, June and July, 1982.

We are requesting, therefore, copies of any and all documents related to the above referenced report and the inspections it is based, including, but not limited to, field interviews, reports, analyses, memoranda, minutes of meetings, telephone legs, transcripts, tape recordings, letters between NRC inspectors and LP&L or its contractors or agents or other documents that detail, describe or provide information concerning this inspection report, its findings or conclusions. We are especially interested in any and. all drafts of the report, and/or working documents related to process through which the final inspection report was arrived at, including but not limited to any and all communication between NRC personnel and representatives of LP&L or its agents on or for the Waterfoni project, especially any and all documents related to the initially proposed penalty to be levied against LP&L.

We are prepared to pay reasonable costs for locating the requested ,

information and reproducing it. The amended act does provide, however, that you may reduce or waive fees if it "is in the public interest because furnishing the information can be considered as primarily benefiting the public." I believe our request plainly fits that cate6ory because all of the information derived from these records will be used to produce newspaper stories that will inform the public about the nature of these critical safety-related questions and the adequacy of the performance of Louisiana Power and6Li ht in its duty to construct a safe and reliable power plant at Waterford. LP&L's failure to have done so, which may be indicated in these records and documents, is of course of fundamental concern to the public. Furthermore, we have good reason to believe that there may have been some improper communications between the parties involved in these documents which would give all those parties motives to want all the true facts of the situation concealed, facts which could ultimately affect the public safety and well-being.

We therefore are convinced that this requests falls well within the bounds of' fee waiver since it will primarily benefit the public. We therefore ask you to waive any fees.

If you rule otherwise and the fees will exceed $100.00, please inform either nyself, Ron Ridenhour, or the editor of Gambit, Gary Esolen, beforo you fill our request.
