On March 18, 1985, I made an FOI Act request to your agency for a list of all Office of Inhres tigations reviews , reports or investigations regarding the Waterfor 3 nuclear plant in Taft, La.

On April 2, 1985, your agency denied my request because "they l pertain to ongoing investigations on Waterford Unit 3." Copies of this correspondence are enclosed.

Please be informed that I consider the reason given for the denial inadequate. The request is denied because the investigations are ongoing, yet included in the NRC response are indications that 10 of the OI reviews are closed. If the cases are closed, I see no reason why the public should not know the nature of the investigation and have access to the record amassed during that investigation, as well as know the outcome of that investigation.

I trust that upon reconsideration, you will reverse the decision denying me access to this material and grant my original request.

As I have made this request in the capacity of a journalist and this information is of timely value, I will appreciate your expediting the consideration of my appeal in every way possible. In any case, I sill expect to receive your decision within 20 business days, as required by law. Thank you for your assistance.

Please send me a list of all Office of Investigations reviews, reports, or investigations regarding the Waterford 3 nuclear plant, located in Taft, La.

The Freedom of Information Act provides that if portions of a document are exempt from release, the remainder must be segregated and disclosed. Therefore, I will expect you to send me all nonexempt portions of the records which I have requested, and ask that you justify any deletions by reference.

I at a journalist employed by The Times-Picayune /The States-Item.

Therefore, I ask that you waive all search and duplication fees.

I intend to use the information requested as a basis for newspaper articles.

As I am making this request in the capacity of a journalist, and this information is of timely value, I would appreciate hearing from your office by telephone, rather than by mail, if any questions regarding my request arise.
