Dear Mr. Fay:

SUBJECT:

POINT BEACH NUCLEAR PLANT UNITS 1 AND 2 - INSER'. ICE TESTING PROGRAM FOR PUMPS AND VALVES By letter dated March 4, 1985 as modified June 11, 1985, we granted interim relief pursuant to 10 CFR 50.55a(g)(6)(i) from those American Society of Mechanical Engineers (ASME) Code requirements for inservice testing (IST) of pumps and valves for which you requested relief in your January 16, 1984 submittal " Point Beach Nuclear Plant Units'1'and 2 pump and valve inservice test programs." We specified that implementation of the testing program should take place no later than August 1,1985 and further specified that the interim relief would remain in effect until the staff had completed its detailed review of your submittals or until February 28, 1986, whichever came first.

The staff has received revisions to your January 16, 1984, IST program for Point Beach Units 1 and 2 dated March 28, August 26, and November 12, 1985. The staff had originally intended to complete its review of your submittals prior to the February 28, 1986, expiration date for the interim relief granted in our March 4 and June 11, 1985 letters. However, the staff has not yet been able to complete its review of your submittals.

The staff has re-reviewed the basis for our granting of interim relief and has determined that adequate basis exists for extending the interim relief beyond February 28, 1986, until the staff completes its detailed review of your submittals. Our determination is based upon our agreement that it is impractical within the limitations of design, geometry and materials of construction of components, for you to meet certain of the specified ASME Code -

requirements and that imposition of those requirements would result in hardships or unusual difficulties without a compensating increase in the level of quality of safety. Therefore, we hereby extend the interim relief previously granted by the staff's letter of March 4,1985 until the staff has completed its detailed review.

Since the scope of the inservice testing will be increased by your proposed programs and the granting of this relief is based only on the impracticality of implementation of selected ASME Code requirements, we have determined that the granting of relief, as authorized by law, will not endanger life or property, or the common defense and security of the public.

The above relief applies only to those requests for relief contained in your 4 January 16, 1984 submittal. With respect to the additional relief requested in your March 28, 1985 letter, our position remains as stated in our June 11, 1985 letter; namely, that pending completion of the staff review, you are required to meet the ASME Code requirement for pump testing relating to this. relief request.
