APPROVAL UNDER 10 CFR 20.302(a) TO RETAIN CONTAMINATED SOIL ONSITE AT FERMI-2 (TAC NO. 65459) j Mr. F. E. Agosti's letter (NRC-87-0076) dated May 26, 1987, submitted a l petition for the disposal of licensed material not previously considered by the NRC in the Fermi-2 Final Environmental Statement (FES), NUREG-0769, l issued in August 1981. The petition submitted pursuant to 10 CFR 20.302(a), i contains a detailed description of licensed material (i.e., contaminated soil within the onsite boundary of the Fermi-2 facility) resulting from the spillage of water from the plant Condensate Storage Tank. The May 26, 1987 submittal presents a thorough analysis and evaluation of the environmental effects relative to the retention of the contaminated soil onsite, as well -

as a commitment to follow specific procedures to minimize the risk of unexpected or hazardous exposure.

In the Fermi-2 FES, the NRC considered the potential effects on the environ- I ment of licensed material from the operation of the Fermi-2 plant, including associated environmental impacts and adverse effects, and concluded that "no l significant environmental impacts are anticipated from normal operational releases of radioactive materials." Because the contaminated soil resulting from the Condensate Storage Tank spillage, as detailed in the May 26, 1987 petition, appears to involve licensed materials containing less than 0.2  ;

percent of the radioactivity (primarily Cobalt-60) already considered acceptable in the FES, and involves exposure pathways much less significant, and radiochemical forms much less mobile than those considered in the FES, l the NRC finds that retention of the contaminated soil onsite, as requested, would have an insignificant radiological impact. Your request to retain and dispose of contaminated soil under 10 C/R 20.302(a) is approved on the  ;
