Confirmatory Action Letter 88-23 During NRC inspections conducted at the Combustion Engineering Fuel Manu-facturing facility in Windsor, Connecticut over the past 10 months, serious weaknesses were identified in the itplementation of your licensed program.

Weaknesses which require your immediate attention include those related to radiation protection, facility operations and management controls. Because of these weaknesses, Mr. Stewart Ebneter of my staff visited your facility or, August 15, 1988 and had a telephone discussion with you on September 8 ar.d 9, 1988, regarding the actions you will take to correct these weaknesses.

Although some program upgrades and improvements have been made during the past 10 months, Combustion Engineering recognizes the need for (1) acceleration of the pace at which the programmatic upgrades are occurring to rapidly bring the facility into compliance with NRC regulations and license requirements and (2) an independent assessment of the facility as daf f ned in your August 26, 1988 j letter by a task force independent of the fuel facility staff to identify the full scope of needed facility changes to preclude future regulatory violations.

Based on that meeting and the subsequent telephone discussions, we understand that you have undertaken, or will undertake, and complete the following actions:

1. You will prepare and document a Performance Improvement Plan (PIP) and submit it to the NRC Region I Regional Administrator, within 45 days of the date of this letter. The PIP will be reviewed and approved by ap-propriate Combustion Engin tering upper level managerrent. The PIP should identify and integrate into a si actions required to bring the Ia,ngle cility comprehensive into compliance plan with all significant regulatory requirements, including those to which you have 07eviously committed, with a scheduled completion date for each item. The deficiencies identified by the NRC include those which were the subject of Confirmatory Action Letter No. 87-14, Inspection Report No. 70-1100/87-05.- Inspection Report No.

70-1100/83-03, Inspection Report No. 70-1100/?8-05 and 70-1100/83-06, and the issues discussed during the December 1, 1937, May 10 and August 3, 19SS meetings at Region I.

J 1 2. You will formally plan, perform and document by December 31, 1988, a  ;

i self-assessment, as described in your August 26, 1988 letter, of the root ,

q causes of (a) the deficiencies identified by the NRC during the past 10 '

l months and (b) the reasons why Combustion Engineering managwent has not i been effective in recognizing and remedying these problems. The. assessment  ;

will include a comprehensive review of all regulatory requirements related  :

to the facility license as stated in the Task Force Charter. In addition, I J as part of the the assessment, you will confirm that program changes i required to bring the facility into compliance, and assure continued compliance, are implemented.

PIP and independent task force by the end of each calendar month to the i NRC Region I Regional Administrator. These reports will be provided until .
