Dear Mr. Scherer:

This is in response to your letter dated April 12, 1989 (LD-89 038), in which you requested authorization to assign U-235 values based on historical data to three B-25 containers of low level waste.

We have reviewed your request and have determined that granting your request will not adversely affect the common defense and security nor the public health and safety and is otherwise in the public interest. Accordingly, we are issuing a one-time limited exemption to the requirement of 10 CFR 74.31(c)(2) by adding license condition, TC (MC&A)-3 to Safeguards Amendment SG-2 of your licente No. SNM-1067, effective upon receipt of this letter as follows:

TC(MC&A)-3 Notwithstanding the requirement of 10 CFR 74.31 (c)(2) that "all quantities in the material accounting records are based on measured values," the licensee may assign values based on historical data to three B-25 containers (No. 1170, 1176, and 1177), as outlined in Enclosure 1 to the memorandum dated April 12, 1989 from A.
