Dear Mr. Rickard:

1 I am responding to your September 30, 1996, letter requesting that the FY 1997 annual fee for License SNM-1067 be assessed pursuant to fee Category 14 rather than any other category. .

Your letter states that, based on your April 23, 1996, letter, all source and special nuclear material not related to decontamination and decommissioning l activities have been transferred from License SNM-1067 to License 06-00217-06, l effective September 30, 1996.

The NRC's Region I Licensing staff has confirmed that, based on your April 23, 1996, request, Items A., B., and C., currently listed on License SNM-1067 (which are classified as fee categories ID and 2C) were added to License 06-00217-06, as Items L., M., and N., when Amendment No. 42 was issued on September 5, 1996 The Office of Nuclear Materials Safety and Safeguards has confirmed that in3he near future they will issue an amendment to License SNM-1067 to delete Items A., B., and C. in accordance with your April 23, 1996, request. The remaining items currently on License SNM-1067 are related to decommissioning and decontamination activities only.

Based on the foregoing, we agree that License SNM-1067 is not subject to the annual fees for FY 1997, since the activities for which annual fees would be assessed (fee Categories ID and 2C) have been conducted under License 06-00217-06 since September 5, 1996. License 06-00217-06 to is subject to the FY 1997 annual fees f or fee categories 3L, 3N, 3P,10, and 20. License SNM-1067 is currently classified in fee categories ID, 2C, and 14; once Items A., B.,

and C. are deleted, the license will be reclassified as fee Category 14 only.

Dear Mr. Pierson:

The Reference (A) amendment was submitted to delete from the subject license, reference to all buildings except Building 21, and all activities except those related to the decommissioning of Building 21 and. subject to thejurisdictiomd questions about which we have corresponded to the NRC, the analysis, packaging, and possession of residual DOE uranium from prior AEC operations at the Windsor site.

Since submittal of Reference ( A), we have begun conducting activities in Building 17 under the authority of License No. 06-00217-06. (Reference B). Decommissioning of ,

Building 21 is continuing under the NRC approved Decommissioning Plan that includes i

addition, accountability of all Special Nuclear Material / Source Material not related to i l - decontamination and decommissioning activity on former AEC programs, has been transferred from License No. SNM-1067 to License No. 06-00217-06.

Based on the requested changes in the Reference (A) amendment, the cessation of all licensed activities except those related to decontamination and decommissioning, and the transfer of accountability for Special Nuclear Material / Source Material from SNM-1067 to 06-00217-06 (except as noted above), all effective by September 30,1996. '

Combustion Engineering requests that the annua] fees for FY1997 for SNM-1067 be assessed pursuant to 10 CFR 171.16-l. Category 14, rather than any other category.
