l ENCLOSURE 1 NOTICE OF VIOLATION Georgia Power Company Docket Nos.: 50-424, 50-425 Vogtle Units 1 and 2 License Nos.: NPF-68, NPF-81 During the Nuclear Regulatory Commission (NRC) inspection conducted from July 8 - August 18, 1989, violations of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violations are listed below.

A. 10 CFR 50.72 paragraph (b)(2) requires a report to be made to the NRC within 4 hours4.62963e-5 days <br />0.00111 hours <br />6.613757e-6 weeks <br />1.522e-6 months <br /> following any event or condition that results in manual or automatic actuation of any engineered safety feature system.

Contrary to the above, on the evening of July 20, 1989, the licensee failed to make a report within the allotted time period following a loss of power to the Unit 2 4.16kv ESF bus and auto start of the turbine driven and train "A" motor driven AFW pumps as a result of an electrical fault on Reserve Auxiliary Transformer "A" while transferring to the Unit Auxiliary Transformer. The following morning, the inspector identified that the licensee failed to recognize that the loss of power to the 4.16kv ESF bus and the start of the turbine driven and train "A" motor driven AFW pumps constituted an ESF actuation.

This is a Severity Level IV violation (Supplement I), applicable to Unit 2 only.

B. 10 CFR 50.73(b)(ii)(I) requires in part that the narrative description of a Licensee Event Report include the method of discovery of each procedural error. 10 CFR 50.73(b)(ii)(J)(2) requires in part that the narrative description of a Licensee Event Report include for each personnel error a discussion of:

(1) whether the error was a cognitive error or procedural error; (2) whether the error was contrary to an approved procedure, was a direct result of an error in an approved procedure, or was associated with an activity or task that was not covered by an approved procedure; and (3) the type of personnel involved (i.e., contractor personnel, utility-licensed operator, utility nonlicensed operator, other utility personnel).

4 Georgia Power Company 2 Docket Nos.: 50-424, 50-425 Vogtle Units 1 and 2 License Nos.: NPF-68, NPF-81 Contrary to the above, on August 3,1989, the NRC identified that a Unit 1 Licensee Event Report No. 89-15, dated July 25, 1989, did not contain appropriate discussion of the personnel error in that:

(1) no method of discovery of the procedural error was included (The oncoming reactor operator (utility-licensed operator) identified the error during the shift turnover.);

(2) no discussion was included regarding the cognitive or procedural error; (3) no discussion was included regarding whether the error was contrary to, error in, or not covered in an approved procedure; and (4) the type of personnel was too general (i.e. operator).

l This is a Severity Level V violation (Supplement I), applicable to Unit 1 only.

Pursuant to the provisions of 10 CFR 2.201, Georgia Power Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to l the Regional Administrator, Region II, and a copy to the NRC Resident l Inspector, Vogtle, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of l Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps

, which will be taken to avoid further violations, and (5) the date when full I compliance will be achieved. Where good cause is shown, consideration will be I given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
