t-L NOTICE OF VIOLATION 1

L Southern Nuclear Operating Company.-Inc. Docket Nos. 50-424 and 50-425 Vogtle' Electric Generating Plant License Nos. NPF-68 and NPF-81 l Units.1 & 2 LDuring an NRC inspection conducted April 19, 1998' through May 16, 1998,

! violations of NRC requirements were identified. In accordance with the l- . General Statement of Policy and Procedure for NRC Enforcement Actions,"

(NUREG 1600).'the violations are listed below:

A' . Technical Specification 5.4.1.a requires that written procedures be -

implemented for the activities identified in Appendix A of Regulatory LGuide 1.33. Revision 2. February 1978 which includes administrative

-procedures for personnel compliance with plant procedures.

Operations Administrative Procedure 00054-C. " Rules For Performing Procedures." Revision ll, provides instructions for performing-activities in accordance.with approved procedures. This procedure.

requires that plant procedure _ steps be performed in secuence unless

'special circumstances warrant or deviations are allowec by the procedure. The procedure further states that the Unit Shift Supervisor l

(USS) may allow procedure steps to be performed out of sequence if it does not result in the omission of required work, violate the intent of the procedure, or create an unsafe plant condition.

Startup Operating-Procedure 12001-C. " Unit Heatup to Hot Shutdown (Mode 5 to Mode 4). Revision 38. Step A4.2.3.b. requires that, while'the reactor coolant system (RCS) is in a water solid condition, ensure all letdown orifice isolation valves remain open.

Contrary to the above, on April 15, 1998, upon identification that one of .the three letdown orifice isolation valves would not open._ the Unit 2 USS proceded to allow operation of the unit in water solid conditions with only two of three letdown orifice isolation valves in the prescribed position. The third letdown orifice isolation valve was opened on April 17 following maintenance repairs.

This 'is a Severity Level IV violation (Supplement I).

B. 10 CFR 50. (Code of Federal Regulation) Appendix B. Criterion V.

Instructions. Procedures, and Drawings, requires, in part, that activities affecting cuality be prescribed and accomplished in accordance with procecures appropriate to the circumstances.

L Procedure 00254-C. " Foreign Material Exclusion and Plant Housekeeping Programs " Revision 18, requires that _ tools, equipment, and material entering and leaving a designated Zone II, foreign material exclusion area be logged on t.he foreign material exclusion inventory log forms.

, Contrary to the above, on April 28, 1998, approximately eight -

< miscellaneous tools, equipment, and materials were identified inside the designated Zone II area around the Unit 1 and Unit 2 spent fuel pools e that were not logged on the foreign material exclusion inventory form.

l Further, one item was identified as being inside.the Zone II area (via

anlopen inventory form line _ item) that had been removed five days earlier. The licensee failed to log out the item in accordance with l procedure requirements 1 This 'is a Severity Level IV violation (Supplement I).

Washington, D.C. 20555. with a copy to the Regional Administrator. Region II.

and a copy to the NRC Resident Inspector. Vogtle, within 30 days of the date

of thenletter transmitting this Notice of Violation (Notice). This reply

_ should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested. the basis for disputing the violation. (2) the corrective steps

'that'have been taken and the results achieved. (3) the corrective steps that

-will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is.not received within the time specified in this Notice, an order or demand for information may be.

issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be-proper should not be taken. Where good cause is shown, consideration will be given to extending the. response time.
