NOTICE OF VIOLATION Southern Nuclear Operating Company Inc. Docket Nos. 50-424 and 50-425 Vogtle Electric Generating Plant License Nos. NPF-68 and NPF-81 Units 1 and 2 During an NRC inspection conducted September 21, through November 3,1997, violations of NRC requirements were identified. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions "

(NUREG 1600), the violations are listed below:

A. Technical Specification 5.4.1.a requires that written procedures be implemented for the activities identified in Appendix A of Regulatory Guide (RG) 1.33. Revision 2. February 1978.

RG 1.33, Revision 2 requires that procedures for operation of onsite alternating current (AC) electrical systems be implemented.

Procedure 11430-1, "480V AC Non IE Electrical Distribution System Alignment " Revision 12, was established to control, in part, the alignment of Unit I diesel generator train A unit heater breakers located on 480-Volt Non IE motor control center (MCC) INBG. This procedure specified that all breakers on 1NBG were required to be closed unless tagged.

Contrary to the above, on October 3, 1997, ten unit heater breakers on MCC INBG were found open and not tagged.

This is a Severity Level IV violation (Supplement I). This violation applies to Unit 1 only.

B. 10 CFR 50 Appendix B Criterion XVI states, in part, that measures shall be established to assure that conditions adverse to quality, such as deficiencies, are promptly identified and corrected.

Contrary to the above, the licensee issued revision 4 of the APEX users manual without implementing adequate corrective actions to provide explicit guidance on the use of the APEX computer code with a core that has less than a ten (10) days burn up history. This issue was first Enclosure )

2 identified in October 1996. The licensee failed to implement identified corrective actions in revision 4 of the APEX users manual prior to the ,

startup of Unit 1 from the seventh refueling outage. The Unit 1 startup occurred in October 1997.

and a copy to the NRC Resident Inspector. Vogtle, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply 4

should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation. (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or demand for information may be issued as to why the license should not be modified, suspended, or revoked. or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

Because your response will be placed in the NRC Public Document Room (PDR) to the extent possible it should not include any personal privacy, proprietay, or safeguards information so that it can be placed in the POR without redaction. However, if you find it necessary to include such information, you should clearly indicate the specific information that you desire not to be placed in the PDR, and provide the legal basis to support your request for withholding the information from the public.
