ENCLOSURE 1 NOTICE OF VIOLATION Georgia Power Company Docket Nos. 50-424 and 50-425 Vogtle Unit 1 and 2 License Nos. NPF-68 and NPF-81 During the Nuclear Regulatory Commission (NT:C) inspection conducted on June 26-30, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1989), the violation is listed below:

10 CFR 50, Appendix B, Criterion XVI, requires that measures shall be established to assure that conditions adverse to quality, such as deficiencies, deviations, defective material and equipment, and noncoformances are promptly identified and corrected. In the case of significant conditions adverse to quality the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition. The identification of the significant condition adverse to quality, the cause of the condition, and the corrective action taken shall be documented and reported to the appropriate levels of management.

I Contrary to the above, on October 14, 1987, the responsible engineer initiated REA-7604 to address the acceptability of 14 oversized penetration seals installed without subdividers as required by design  ;

test data. The evaluator was requested to determine if the oversized i penetration seals were capable of providing the minimum three hour fire rating as required by the FSAR and to make appropriate changes to the FSAR if necessary. No action had been taken to address the concerns of REA-7604 at the time of the inspection.

This is a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, Georgia Power Company is hereby i required to submit a written statement or explanation to the Nuclear Regulatory 1 Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy l to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, Vogtle within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include [for each violation]: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full l
