SAFEGUARDS INFORMATION NOTICE OF VIOLATION Southem Nuclear Operating Company, Inc.

Docket Nos. 50-424,50-425 Vogtle License Nos. NPF-68, NPF-81 During and NRC inspection conducted January 25-27,1999, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

1 Chapter 9 of the Physical Security Plan, Revision 37, dated December 1998, states that the security response force is designed to permit rapid, initial interception of intruders and that response force officer (s) interpose himself/herself between the intruder (s) and the vital area nearest to the point of penetration.

l Contrary to the above, on numerous occasions from March 1997 to October 1998, select response force officers were posted in locations that wculd not permit them to interpose themselves between the intruder (s) and the vital area nearest to the point of penetration.

j This is a Severity Level IV violation (Supplement 111).

The NRC has concluded that information regarunig the rearon for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in this inspection i

report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In tha' mse, or if you choose to respond, clearly mark your response as a

" Reply to a Notice ci uolation," and send it to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washlagton DC 20555 with a copy to the Regional Administrator, Region 11, and a copy to the NRC Resident inspector at the facility which is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest the enforcement action, you should also provide a copy of your response, with the basis for your denial, to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

If you choose to respond, your response will be placed in the NRC Public Document Room (PDR). Therefore, to the extent possible, the response shou!d not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

In accordance with 10 CFR 19.11, you may be required to post this Notice within two working days.
