NOTICE OF VIOLATION Southern Nuclear Operating Company, Inc. Docket No. 50-424 Vogtle Electric Generating Plant License No. NPF-68 Unit 1 During an NRC inspection conducted August 16,1998, through September 26,1998, a violation of NRC requirements was idenafied. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings, requires, in part, that activities affecting quality be prescribed and accomplished in accordance with procedures appropriate to the circumstances. ,

I Procedure 00400-C, Plant Design Control, Revision 26, requires, in part, dunng i implementation of Design Change Packages (DCP) that controls are to be established l and maintained to ensure that physical changes to the plant are controlled and the functions of safety related equipment are not impacted.

DCP 98-V1N0011, Diesel Generator (DG) Exhaust Stack, for emergency DG 1 A exhaust enclosure missile barrier, was the implementing document to modify the existing concrete structure. The DCP required the partial demolition of the existing l

structure and the removal of the resultant debris. During the demolition phase a temporary exhaust cover was to be installed to prevent debris from entering the exhaust piping and to ensure the DG would continue to be capable of performing its intended I safety function.

Contrary to the above, on August 24,1998, during the performance of DCP 98-V1N0011 on DG 1 A exhaust enclosure missile barrier, the licensee failed to adequately establish sufficient procedural control for the demolition of the concrete missile barrier. The lack of provisions to control the demolition process impacted the safety-related function of the diesel. Specifically, the accumulation of sufficient concrete l debris at the temporary cover exhaust outlet led to determination by the licensee that I DG 1 A may not have been capable of performing its safety function if called upon due to excessive exhaust backpressure.

This is a Severity Level IV Violation (Supplement 1).

The NRC has concluded that information regarding the reasons for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date full compliance was achieved is already adequately addressed on the docket in this inspection report.
