Gentlemen:

SUBJECT: NRC INSPECTION REPORT NO. 50-400/87-07

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

Ms. O. Masnyk on January 27-28, 1987. The inspection included a review of

activities authorized for your Shearon Harris facility. At the conclusion of the

inspection, the findings were discussed with those members of your staff

identified in the enclosed inspection report.

NRC concerns relative to the inspection findings were discussed by Mr. M. L. Ernst,

Deputy Regional Administrator, NRC, Region II, with Mr. M. A. Duffie, Senior Vice

President, Nuclear Generation in an Enforcement Conference held on February 4,

1987.

Areas examined during the inspection are identified in the report. Within these

areas, the inspection consisted of selective examinations of procedures and

representative records, interviews with personnel, and observation of activities

in progress.

The violation described in the enclosed inspection report is under consideration

for escalated enforcement action. Accordingly, no Notice of Violation is being

issued at this time, and no response to this letter is required. However, please

be advised that the number and characterization of violations described in the

enclosed inspection report may change as a result of further NRC review. You

will be advised by separate correspondence of the results of our deliberations

on this matter.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure; therefore, the enclosure to

this letter, with the exception of the report cover page which presents a

nonexempt summary, will not be placed in the NRC Public Document Room.
