Dear Administrative Judges:

On January 17, 1984 I provided the Atomic Safety and Licensing Board and the parties to this proceeding a copy of Commonwealth Edison Company's report on the re-inspection program conducted at Byron as a result of non-compliance items 50-454/82-05-19 and 50-455/82-04-19. It is clear that the Licensing Board, whose decision is now pending on appeal before this Board, relied heavily upon matters related to the reinspection program in denying Commonwealth Edison Company's application for an operating license for the Byron Station.

Given the importance of the reinspection program to this appeal, I am enclosing copies of the reinspection program report (Attachment 1) and related documents. The additional documents are: (1) Commonwealth Edison Company's preliminary reinspection report, dated October 28, 1983 (Attachment 2); (2) the NRC Staff's initial response to the 8402060187 840127 PDR ADOCK 05000454 0 PDR

Administrative Judges Page Two January 27, 1984 Company's preliminary report, dated November 18, 1983 (Attachment 3); and (3) the NRC Staff's inspection report concerning the reinspection program, dated December 28, 1983 (Attachment 4). I am providing the enclosed documents for the convenience of the individual members of this Board; they were previously served upon the Atomic Safety and Licensing Appeal Board Panel at the time they were served upon the Licensing Board and parties.
