Dear Administrative Judges:

In accordance with its obligation to inform the Board of occurrences which may be relevant to the above-captioned proceedings, Commonwealth Edison Company hereby informs the Board that Allen Koca was terminated from his position as Quality Assurance Supervisor for Hatfield Electric Company effective October 21, 1983. During a meeting with represen-tatives of Commonwealth Edison at Byron on August 5, 1983, members of the Region III Staff of the Nuclear Regulatory Commission expressed their concern about Mr. Koca's ability to function effectively within Hatfield's quality assurance program. As understood by Commonwealth Edison personnel, the Staff's concern was that friction between Hatfield's quality control inspectors and Mr. Koca was undermining his ability to assist in the implementation of an effective quality assurance program. The Staff also expressed concern about Mr. Koca's ability to perform his job responsibilities effectively. Commonwealth Edison concurred with the Staff's assessment of Mr. Koca.

Mr. Koca was not terminated because of any findings of wrongdoing on his part. The vast majority of allegations

-involving Hatfield's quality assurance program and Mr. Koca personally have proven to be unsubstantiated, Hatfield's quality assurance program is functioning satisfactorily, and to the Company's knowledge there have been no findings of wilful wrongdoing by Mr. Koca. Removal of Mr. Koca as Quality Assurance Supervisor, however, was viewed to be an appropriate step toward reinstilling confidence in Hatfield's quality assurance program.

Mr. Koca's termination should not be deemed to be a reflection on his credibility as a witness before the Board.

Mr. Koca's testimony focused on the training and certification of John Hughes, and on the testing of QA/QC trainees. On these issues there have been no findings by the NRC Staff which would indicate that the specific allegations were substantiated or suggest that Mr. Koca was anything but truthful before the Board.

Information Needed Prior to Fuel Load of Byron 1 Your letter of September 23, 1983 revised the target date for Byron 1 fuel load to February 15, 1984. It is our goal to resolve by fuel load all the outstanding items and confirmatory issues identified in our original Safety Evaluation Report (SER).

Enclosure 1 summarizes the information we need from you to resolve these issues. If an item is not listed in the enclosure, it means that is resolved or that we have all the information that we need at this time. (Supplement 3 to the SER, issued in November 1983, provides a summary of all the resolved items.)

Provide a response to the items in Enclosure 1 or a justification for proceeding with fuel load with the item unresolved. We need this response at least 60 days prior to your fuel load date so that we may complete our safety evaluation 30 days prior to fuel load.

All the items have been discussed extensively with T. Tramm of your staff.

_ ,, .,r-- .------m ENCLOSURE 1 INFORMATION NEEDED PRIOR TO BYRON 1 FUEL LOAD Outstanding Items (1) Additional information to confirm pipeline foundation design - Provide soils information at area 12 as requested in our June 1,1982 letter. The infcrmation provided thus far is not sufficient for us to resolve the concern for differential soil settlement effects on the pipeline.

(2) Turbine missile evaluation - Provide the turbine maintenance program discussed during the November 17, 1983 meeting (meeting summary issued December 6,1983.)

(4) Pump and valve operability assurance - Provide the information we requested during discussions on November 8, 1983.

(6) Seismic and dynamic qualification of equipment - Provide the information we requested during discussions on November 8, 1983.

(7) Environmental qualification of electrical equipment - Provide the remaining information not included in your December 6, 1983 letter.

(9) TMI action item II.F.2: Inadequate Core Cooling Instrumentation. Expand

, your August 13, 1982 response, Item (4), to explain how your system conforms to NUREG-0737 Item II.F.2.

(10) Steam Generator flow-induced vibrations - Provide the plant-specific information discussed on page B-85 of NUREG-1014 " Safety Evaluation Report related to the D4/05/E Steam Generator Design Mcdificaten."

(13) Fire protection program - Provide responses to the concerns disce , sed in our August 3,1983 letter and again discussed in the October 28, 1983 meeting (meeting summary issued November 1, 1983).

(17) Control iaom human factors review - Provide the responses discussed during the October 26, 1983 meeting (meeting summary issued November 7, 1983).

Confirmatory Issues (1) Confirmatory analysis to verify river screenhouse seismic response analysis - confirm the soil properties used the analysis reauested on page 2-32 of the original SER. Your June 15, 1983 letter and the the additional information you provided in December 1983 is not

-sufficient.

(16) Charging pump deadheading - Your September 16, 1983 letter proposes an interim plan of operation until the changes are completed. Provide a discussion of the worst single failure for this interim plan, as we reouested during a November 30, 1983 telephone conversation.
