- Attention: Mr. C. E. Murphy File: X7BC10 Log: GM-540 Gentlemen:

With reference to your December 11, 1979 transmittal of inspection .

report number 50-424/79-17 and 50-425/79-17 and per discussions in the Region II I6E offices this morning with Mr. Jack Bryant and others of your staff, we are submitting the following information.

1. With reference to *Se non-compliance discussed in item 5 of the inspection report and Appendix A of your transmittal, we note that prior to the present circumstances surrounding backfill at Plant Vogtle we had not considered this type occurrence as falling under the reporting requirements of 10CFR50.55(c) until our preliminary evaluations were availabic. However, since the exit interview at the Vogtle site where this non-compliance was first discussed we have taken corrective measures to assure that other occurrence of this nature will tut reported to the Region II I&E offices. These measures were implemented via increased emphasis from Georgia Power Company management to all appropriate personnel in the form of both written and oral communications. Full compliance with the referenced requirements is considered to be achieved.
2. With reference to the third paragraph of Appendix A it was agreed the word "possible" is to be inserted between the words "and undermining".
