The decision by the Nuclear Regulatory Commission to exercise its discretionary statutory authority under the Price-Anderson Act to extend Government indemnity to spent reactor fuel stored at a reactor site different from the one where it was generated appears to conform entirely ,

with the spirit and intent of the Price-Anderson Act. Financial protection for those individuals subjected to loss through a nuclear occurrence is and must continue to be the main thrust of the Price-Anderson Act.

In order to maintain a desired full core discharge capacity at an operating site, it may become necessary to store the spent fuel generated by that site at another licensed site. While this need may not have been realized in the drafting stage of the Price-Anderson Act, the fact remains that the intent was to indemnify a licensed facility regardless of the source of spent fuel and to protect the public against an occurrence involving all nuclear hazards including spent fuel storage.

Considering the purpose of the Price-Anderson Act, Georgia Power Company completely agrees with the NRC's decision and concurs with their
