WITHDRAWAL 0F TECHNICAL SPECIFICATION (TS) CHANGE REQUEST 94-08, PEACH BOTTOM ATOMIC POWER STATION, UNIT 2 (TAC N0.91338)

Dear Mr. Hunger:

By letter dated January 13, 1995, as. supplemented by letters dated March 14, 1995 and April 12, 1995, PECO Energy Company submitted License Change Request 94-08 which was an application for an amendment to the Peach Bottom Atomic l Power Station, Units 2 and 3, Operating License Nos. DPR-44 and DPR-56. The proposed changes modified Tables 3.7.1 and 3.7.4 of the TS to reflect a change in the number of primary containment penetrations and isolation valves l l associated with the traversing in-core probe (TIP) system. The change in l primary containment penetrations was the result of planned modifications to the TIP system for both Unit 2 and Unit 3. '

l On April 24, 1995, the staff issued license amendment 203 to the Unit 3 license which revised the TSs in accordance with PEC0's application, in issuing the amendment to the Unit 3 license, the staff stated:

In your January 13, 1995 application, you requested that the amendments be issued for both Peach Bottom Unit 2 and Unit 3. The staff has issued the requested license amendment for Unit 3 only.

During a February 7, 1994 telephone conference, your staff indicated that the TIP modification will not be implemented on Unit 2 until September 1996. By that time, it is expected that l the NRC will have approved and you will have implemented the

! improved Technical Specifications (ITS) requested in your '

I submittal of September 29, 1994. ( )

l The proposed ITS do not contain tables equivalent to Tables 3.7.1 l and 3.7.4 in the current TS. Therefore, in order to prevent .

confusion, the staff will not issue the requested TIP license @

l amendment for Unit 2 because, in all likelihood, it would not be V implemented into the TS. The staff previously published a Notice of Consideration of Issuance to Facility Operating Licenses.

Proposed No Significant Hazards Consideration, and Opportunity for a Hearing in the Federal Reaister for the TIP amendment for Unit 3 only. You are requested to inform the staff if you desire to have the staff approve the TIP amendment for Unit 2 as the review process for your proposed ITS conversion progresses.
