l. Imposition of Civil Penalty (NRC Inspection Report No. 50-128/86-01)

Dear Sir:

In reference to the above Notice of Violation and the conditions for reply as stated on page 2, " Consideration may be given to extending the response time for good cause shown", the Texas i Engineering Experiment Station (Licensee) requests a 30 day extension of the reply date to 22 September 1986 for the following reason:

! As discussed during the enforcement conference of 21 May 1986, one of the corrective actions planned by the Licensee was the addition of a prominent reactor administrator to the NSC technical staff for the purpose of providing needed assistance in operational and l developmental research programs for the reactor. Dr. Jon A.

Reuscher, Manager, Reactor Development and Applications at Sandia Laboratory, Albuquerque, New Mexico, will join the staff on 1 September as Director of Nuclear Research Reactor Programs. It is very desirable that Dr. Reuscher be given the opportunity to review the notice of violation and take part in the evaluation and reply process. An extension of 30 days would provide adequate time for his i involvement.
