SUBJECT: NRC INSPECTION REPORT 50-128/97-01 AND NOTICE OF VIOLATION

Dear Dr. Russell:

,

An NRC inspection wes conducted March 17-21,1997, at the Nuclear Science Center.

The enc,0 sed report presents the scope and results of that inspection.

Our inspector concluded that your reactor was operated safely. However, eight violations

were identifir.d involving the failure to: implement the operator requalification program,

conduct operator physical examinations within the required frequency, perform reactor

safety board audits, obtain license authority to possess certain byproduct material, perform

.

radiation surveys, demonstrate compliance with dose limits in unrestricted areas, and

'

conduct onsite emergency drills. Collectively, the violations indicate a need for increased

management attention and oversight of licensed activities. The failure to perform audits

was also identified as a violation during inspections conducted in 1992 and 1994.

These violations are cited in the enclosed Notice of Violation (Notice) and the

circumstances . surrounding the violations are described in detail in the enclosed report.

l

Please note that you are required to respond to this letter and should follow the

instructions specified in the enclosed Notice when preparing your response. The NRC will

,

use your response, in part, to determine whether further enforcement' action is necessary

to ensure compliance with regulatory requirements.

Additionally, a management meeting involving your staff and NRC representatives has been

scheduled to be held June 19,1997, at 1 p.m. CDT, at the Nuclear Science Center to

review the inspection findings identified in the enclosed inspection report.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter,

its enclosures, and your response will be placed in the NRC Public Document Room (PDR).

To the extent possible, your response should not include any personal privacy, proprietary,

or safeguards information so that it can be placed in the PDR without redaction.
