Dear Dr. Russell:

Thank you for your letter of June 16,1997, in response to our letter and Notice of Violation dated May 29,1997. We have reviewed your reply and noted your denial of Violations E and F. We also reviewed the additional information you have provided to l Mr. Ricketson after completion of the inspection and during the management meeting held June 19,1997, at the Nuclear Science Center. Our review of the information concluded that the violations occurred as stated in the Notice of Violation, with one exception. The exception involved Violation E, a failure to survey. We have determined that this violation should be revised to more clearly state our concern that adequate surveys were not performed. The revised Notice of Violation is included in Enclosure 1. Our analysis of your response is included in Enclosure 2 to this letter.

Because you implemented corrective actions for all violations, including those you contested, we find your actions responsive to the concerns raised in our Notice of Violation. We will review the implementation of your corrective actions during a future inspection to determine that full compliance has been achieved and will be maintained.
