The ATWS Fule (10 CPt $0.62. Re Transients Without Scram (ATWS)quittnents for Feduction ofNuclear Events for Light-Water-Cooled Risk frcm Anticipated Power Plants) requires inprovenents in the design and creration of concercial nuclear peker facilities to reduce the Iflelihecd of failure to shutdown the reactor folicwing anticipated transients, and to mitigate the consequences of an ATWS event. The requirenents for a boiling water reactor are to install an alternate rod injec-ticrLIARI) systtm, a stardby itquid control system (SLCS) and to trip the reactor cholant recirculation pupps autom atically under conditions indicative of an ATUS.

CPU Nuclear Corporation (CPUN/ licensee) provided infor1 nation by letters dated Septer;ter 3,1987. Pecember 30, 1987 and April 79, 1988 concerning their imple-pentation of the ATWS Pule. The staff and the Science Applications Interna-tional Corporation, cur consultant, have reviewed these sutrittals. Fased on this review, we have concluded that the ARI design dces not rcet the' diversity requircrents of the ATES Rule and, as a result, is rot acceptable. Fewever, we do not believe that the issues related to this ncnacceptance are of sufficient safety significance to delay irplettentation of the ARI system or replace equip-nent already installed. In order to corply with the ATWS Fule, the licenste shall provide an ARI system with instrument ccepcments that ate diverse frce the reactor trip system before restart following the next refueling cutage (Refueling Outage 13P). You are also required to rerfeit a preoperational test to serify thtt the actual ARI function time is within the design 11mit. GPUN is also required to provide equiprent technical specifications including opetebility and surstillance requirerents. The staff will providt guidance on technical specification requiretrentr for the ATWS/RPT system in a separate docueent . Our Safety Evaluation (SE), which provides the review details regaiding this cor clusion, is encitaed.

Based on the above, we request that )cu dccurent your intent legarding reeting cur requirements related to (1) dinersity and preoperaticnal testing of the ARI System ard (2) technical specification requirerents for the ATWS/RPT systec's.
