Dear Mr. Roche:
On June 4,1998, the NRC's Office of Investigations (01), Region I Field Office, initiated an investigation to determine whether a Site Protection Officer (SPO), employed by'GPU-Nuclear at the Oyster Creek Nuclear Generating Station (OCNGS), had been discriminated against as a result of contacting the NRC in November 1997 with security and safety concerns.~ Based upon the evidence developed during this investigation, as well as the SPO's unwillingness to provide testimony in this matter, Of could not substantiate that the SPO was discriminated against as a result of contacting the NRC with security and safety concerns'regarding OCNGS. The 01 investigation, documented in 01 Report No. 1-98 027, L
was completed on September 1,1998. A copy of the synopsis of the 01 report is enclosed.

l l SYNOPSIS This investigation was initiated on June 4,1998, by the U.S. Nuclear Regulatory Comminion (NRC), Office ofInvestigations (01), Region I, to detennine whether a Site Protection Officer (SPO), employed by General Public Utilities-Nuclear at the Oyster Creek Nuclear Generating Station (OCNGS), had been d!Wmin=+d against as a result of contadng the NRC in November 1997 with security and safety concems. Ibe diWmination, as alleged, was in the form of selective and retaliatory discipline, and the creation of a hostile work environment.
Based upon the evidence developed during this investigation, as well as the SPO's unwillingness to provide testimony in this mann, OI could not substantiate that the SPO was discrimin='M_
against as a result of contacting the NRC with security and safety concerns regarding OCNGS.
