Dear Mr. Fiedler:

SUPJECT: REISSUANCE OF APPENDIX A TECHNICAL SPECIFICATIONS (TS)

Pe: Oyster Creek fluclear Generating Station In the past, the staff and GPU Nuclear (the licensee) have discussed the reissuance of the Oyster Creek Appendix A Technical Specification (TS) in its entirety. The staff stated in its letter' dated February 22,1983, that such a request from the licensee would be considered by the staff for the convenience of flRC and for clarification purposes and thus exempt from the Itcensee fee schedule. The licensee responded by letter dated December 8, 1983, submitting such a reouest for clarity and format purposes.

To date, the staff has not acted on this request from the licensee. The staff has issued 18 aren&ents to the Oyster Creek TS since December 1983 which are not included in the licensee's December 8, 1983, submittal. In the staff's Progress Peview meeting with the licensee on June 19, 1985, the licensee agreed to withdraw its December 8,1983, request.

This closes out the staff's action on this submittal; however, this letter does not change the intent of the staff's letter of February 22, 1983.

It is still our position that to reissue the Appendix A TS, either at your request or as an action initiated by the NRC, is for the convenience of NRC and for clarification of the TS. Thus, your request for the reissuance of the TS will be exempt from the license fee schedule pursuant to 10 CFR 170.11(b)(1).
