REVISED NOTICE OF VIOLATION (NRC Inspection Report 50-267/94-03 & Office of Investigations Reports 4-94-010 and 4-95-015)

Dear Mr. Neely:

This is in reference to the Notice of Violation issued to Scientific Ecology Group (SEG) on October 30, 1995, based on SEG employees falsifying radiation survey records at the Fort St. Vrain Nuclear Generating Station.

The Notice of Violation has been revised to reflect the NRC's reanalysis of information in that case. Our reanalysis was done in response to inforrration -

provided by two former SEG supervisors who also were issued Notices of Violation on October 30, 1995. Our reanalysis has determined that there is insufficient evidence to support our earlier conclusion that the backdating of survey records by SEG supervisory personnel was, in and of itself, done with the intent to mislead or falsify records.

The NRC continues to believe that the avidence developed in this case supports the conclusion that radiation protection technicians knowingly included false ,

information regarding survey instrument usage and calibration data on the l subject records. Thus, the enclosed, revised Notice of Violation reflects only our change in position relative to the backdating of the records.

In that SEG's November 29, 1995 reply to the Notice of Violation adequately l addressed the information requested in the Notice, no response to the revised Notice of Violation is required.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosure, and any response you choose to submit will be **

placed.in the NRC Public Document Room (PDR). To the extent possible, any

response you choose to submit should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
