SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 90-16)

This is in reference to NRC's September 28, 1990, inspection of rediological controls at your. company's Fort St. Vrain Nuclear Generating Station (FSV),

and to the October 18,1990,' enforcement conference with you and other Public Service Company of. Colorado (PSC) representatives in NRC's Region IV office in Arlington, Texas, at which the results of this inspection were discussed.

NRC's inspection was prompted by its becoming aware, on September P6, 1990, of'

apparent poor radiological protection practices associated with a September 19, 1990, entry into FSV's Hot Service Facility (HSF) for the purpose of gathering and removing from the HSF radioactive metal samples which had been taken from irradiated reactor core components. The results of this inspection and a detailed description of this event were provided PSC in a report dated October 12, 1990.

As.the inspection report indicated, six violations of NRC requirements were disclosed by NRC's review of this event. These involved failures to: perform necessary radiation surveys, follow FS'! procedures regarding the development cf radiation work permits, ensure proper personnel monitoM ng devices were enployed label packages containing radioactive material, provide appropriate in:tructions to a worker entering the HSF, and post a radiation area. NRC's inspection also confirmed, as PSC's own investigation of the September 19 l

event had indicated, that the radiation exposures to personnel involved in l

this event were relatively low and did not approach regulatory limits.

L The enforcement conference was conducted to discuss these violations and their significance, the reason or reasons for their occurrence, and the corrective

actions taken by PSC in order for NRC to determine appropriate enforcement action. Based on these discussions and our inspection findings, NRC concludes that this event, while not posing a substantial potential for an exposure in

excess of NRC limits, revealed weaknesses in PSC's radiation protection

,

practices at FSV and inadequate radiation protection management involvement in

[

preparing for evolutions such as that which took place on September 19, in NRC's view, these violations resulted from both systemic weaknesses and personnel error.

Based on NRC's view that these violations neither posed a substantial potential for an overexposure nor reflected a breakdown in the FSV radiation protection program, NRC has classified each of the violations et, Severity Level IV, in accordance with its Enforcement policy. Five violations are

included in the enclosed Notice of Violation (Notice). Although PSC stated at the October 18 enforcement conference that its own investigation of the September 19 event had disclosed most of these deficiencies, raising the possibility that NRC could elect not to issue a Notice in accordance with Section V.G.I. of its' Enforcement Policy, NRC has elected to issue a Notice because: 1) there was no indication at the time of HRC's inspection that

specific violations of requirements had been identified or that corrective actions to preclude recurrence of such violations had been taken or were planned, and 2) these violations have indicated weaknesses in FSV radiation protection practices and NRC believes that a formal response to these violations is warranted. The sixth violation, involving a failure to post a i

radiation area, was clearly identified and corrected by PSC prior to NRC's

inspection. Thus,'it has not been included in the enclosed Notice in accordance with Section V.G.I. of the Enforcement Policy.

PSC is required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing its response.

In its response, PSC should document the specific actions taken and any additional actions it plans to prevent recurrence of the individual violations.

In

addition, because these violations indicated systemic weaknesses and inadequate management involvement, as indicated earlict in this letter, NRC requests PSCC to address in its response the corrective actions planned or taken to resolve these matters as well. After reviewing PSC's response to this Notice, including its proposed corrective actions, and the results of future inspections, the NRC will determine whether further NRC enforcement action is.necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a. copy of this letter and its enclosure will be placed in_ the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980 Pub. L. No.96-511.
