PUBLIC SERVICE COMPANY RESPONSE TO NRC NOTICE OF VIOLATION AND PROPOSED IMPOSITION OF CIVIL PENALTY We are in receipt of your letters of November 10, 1993 responding to the Notice of Violation and Proposed Imposition of Civil Penalty that was issued on October 13, 1993.
In your response, you deny the violation, protest the civil penalty, request mitigation of the civil penalty in the event the NRC continues to find that a violation occurred and " formally request a hearing on this matter in accordance with the provisions of 10 CFR Part 2, Section 2.205(d)." Please note that, pursuant to 10 CFR 2.205(d), you may only request a hearing if the NRC issues an order imposing a civil peanalty. At this point, the NRC has only oronosed a civil penalty. It has not yet evaluated your response or made a determination on whether to issue an order imposing a civil penalty. Accordingly your formal i

In your response, you offer "to provide mitigation details as appropriate." The staff would be willing to consider your
