Dear Mr. Hickey:
This letter requests additional time for Public Service Company of Colorado (PSCo) to respond to the NRC's comments in Reference 1, regarding the Trust Agreement which PSCO established to cover remaining costs associated with Fort, St. Vrain decommissioning.
The Trust Agreement submitted in Reference 2 was established in the amount of $8.5 million, and is an agreement between PSCo and the Wells Fargo Bank of Colorado. The Wells Fargo Bank is currently in the process of being purchased by the Bank of New York, and the administration of trust accounts is in transition. In order to allow further review and time to process any Trust Agreement revisions, PSCo requests an additional 45 days to respond to Reference 1 comments.
With the advanced stage of the Fort St. Vrain license termination process, and the few tasks remaining to be funded, PSCo considers that the current Trust Agreement would provide for their completion if required.
