IMPACT OF THE FINAL DECOMMISSIONING RULE ON FORT ST. VRAIN DECOMMISSIONING

Dear Mr. Crawford:

The U.S. Nuclear Regulatory Commission has reviewed the Public Service Company of Colorado's (PSC) August 22, 1996, submittal (P-96073) entitled, " Impact of the Final Decommissioning Rule on Fort St. Vrain Final Decommissioning."

Based on its review, the NRC staff has concluded that the Decommissioning Plan (DP), as amended, which has been approved by the staff, satisfies all of the elements of a license termination plan as required by the recently issued revisions to the Reactor Decommissioning Rule,10 CFR 50.82(a)(9), and the related modifications to the requirements for an updated Final Safety Analysis Report ' 9 R) or Updated Safety Analysis Report (USAR). 10 CFR 50.71(e)(4).

The ba for our determination is discussed below in detail.

On November 23, 1992, the NRC approved the Decommissioning Plan, su)plement to the Environmental Report, and revised Technical Specifications for : ort Saint 4 Vrain (FSV). NRC has concluded that the submittal and approval of these documents meet the requirements rf 10 CFR 50.82(a)(9)(i), requiring submittal of a termination plan at least two years before license termination. In addition, NRC has also concluded that the FSV-approved DP meets the information requirements as defined in 10 CFR 50.82(a)(9)(ii)(A), " Site Characterization": 10 CFR 50.82(a)(9)(ii)(B), " Identification of Remaining Dismantlement Activities": 10 CFR 50.82(a)(9)(ii)(C), " Plans for Site Remediation": 10 CFR 50.82(a)(9)(1)(E), " Description of the End Use of the Site, if Restricted": and 10 CFR 50.82(a)(9)(ii)(F), "An Updated Site-Specific Analysis of the Remaining Decommissioning Costs.

The requirements of 10 CFR 50.82(a)(9)(ii)(G), "A Su)plement to the Environmental Report " were met by the licensee's su)mittal to and NRC's approval of the supplement to the Environmental Report. The requirements of 10 CFR 50.82(a)(9)(ii)(D), " Detailed Plans for the Final Radiation Survey "

were met by the FSV submittal to and NRC approval of the FSV Final Survey Plan in January 26, 1995.

The NRC staff considers the DP to be the functional equivalent of a USAR, '

pa'rticularly considering the stage of activities at FSV, and the quarterly reporting requirement and annual update commitment to satisfy the updating requirement of 10 CFR 50.71(e)(4).

As to the process for _ staff approval of termination of the FSV license, the procedures in the revised Reactor Decommissioning rule are controlling. Thus, the licensee's termination request, which is anticipated to be filed shortly, will be processed as a request for license amendment (10 CFR 50.82(a)(10)).

Pursuant to 10 CFR 50.82(a)(9) and 2.1205(c), the NRC will notice receipt of the termination request and the termination plan and make them available for public comment. The staff will provide an opportunity for a hearing under Subpart L of 10 CFR Part 2 (10 CFR 2.1205(c)). If a request for a hearing is filed and granted. that proceeding must be completed )rior to license termination (10 CFR 2.1201(a)(3)). The staff will pu)lish notice of, and hold in the vicinity of the plant, a public meeting regarding the termination plan (10 CFR 50.82(a)(9)).
