Dear Mr. Hoyle:

The NRC Order To Show cause to the Georgia Institute of Technology Research Reactor arrived in my office on November 15, 1985, some 48 days after it was mailed by NRC. The reason for the delay is not the U.S. Post Office; it was within Georgia Tech. The order was simply sent to the Georgia Institute of Technology. Nobody seemed to know what to do with it. It finally arrived!

On November 15, 1985, I sent a letter to the Office of Nuclear Material Safety and Safeguards requesting NRC approval to use NRC approved ETR fuel element shipping container, USA /9134 B() F, to ship our unirradiated fuel to Oak Ridge (copy enclosed). I would like to request further that, since DOE is handling all arrangements for shipping the fuel, the Georgia Institute of Technology be exempt from having to develop a Quality Assurance program for shipping the fuel.

Currently our inventory of23gnitradiated fuel is 24 fully loaded elements (188 9 of g35 in each), two elements with removable fuel plates (141 g. U in eaggg, and one partially loaded element with 71.09 grams of U . We would like to retain removable with in our vaultplates. one fully loaded The total element amount andof tg35 U *in the three elements is approximately 472 grams. The elements with removable plates were designed for experiments involving fuel reactivity worth and void coefficients. We seek NRC approval to retain

these three elements.

Hoyle Page 2 November 20, 1985 Finally, based on the conversation with Mr. Keith Brown of CG&G, Idaho who is coordinating for DOE the shipment of fuel, and who thinks that the 120 days period is too short, and the fact that we at Georgia Tech are starting late due to mail delay, it appears to me that we will need more time. Thus I am requesting from NRC a 60-day extension period. I will make every effort however to have the fuel shipped out of here on time and on schedule.
