Dear Mr. Mcdonald:
The Pennsylvania State University Breazeale Reactor (PSBR) is committed by our response to the NRC, "Show Cause Letter," to ship off-site, 5 partial and 2 control fuel elements possessed under NRC license No. R-2.
These elements are of the 10 plate design with the uranium enriched to 93% in U-235.
The 5 partial elements have unfueled aluminum plated in some of the positions which would hold fueled plates in a full element. The 2 control elements have only 7 plates, thus providing space in the center of the element for insertion of a control rod. These two control elements are also fitted with a boss on the top end to facilitate attaching a control rod guide tube. The maximum U-235 contained in any one of the 7 elements is 133.47 grams. The seven elements contain a total of less than 700 grams of U-235.
A quality assurance program has been prepared by the PSBR staff to ensure compliance with 10CFR71, paragraph 71.12.
A copy of that quality assurance program is contained herewith.
The PSBR proposes to use 2 Model ETR, Identification number USA /9134/B( )F packages to ship the referenced fuel. These packages are certified by NRC Certificate of Compliance number 9134. The fuel will be shipped to a DOE secure facility.
By this letter, supported by the enclosed material, The Pennsylvania State University hereby requests to be named a registered user of the above described shipping containers for the purpose outlined herein.
