Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC) Office of Investigations (01) completed report regarding alleged discrimination by the Georgia Institute of Technology against an employee who filed a complaint with the U.S. Department of Labor (DOL).

The D0L record indicates that on February 13, 1997, the DOL District Director's finding was that discrimination was not a factor in the action comprising the complaint. The DOL finding was not appealed, L OI determined that there was insufficient evidence.to substantiate the

l. allegation of discrimination. We plan no further action with regard to this l matter. Should you have any questions concerning this letter, please contact l us.

The U.S. Nuclear Regulatory Commission (NRC), Region 11, Office of j investigations initiated this investigation on December 9,1996, to determine if a Georgia institute of Technology, Neely Nuclear Research Center employee was the victim of discrimination due to reporting safety concerns to the NRC.

Based on a review of the evidence and the Department of Labor investigative file, this investigation did not substantiate that the employee was the victim of discrimination due to reporting safety concerns to the NRC.
