Dear Mr. Guild:

This is in further response to your letter dated November 21, 1985, in which

you requested, pursuant to the Freedom of Information Act (F0IA), copies of

all records related to Inspection Reports 50-456/85-21 and 50-457/85-22

regarding the Braidwood plant.

Portions of the 47 records listed on the enclosed Appendix C and all of the

records listed on the enclosed Appendix D contain advice, opinions, and

recommendations of the staff and/or are investigatory records compiled for law

enforcement purposes and are being withheld from public disclosure pursuant to

Exemptions (5), (6), (7)(A), and (7)(D) of the F0IA (5 U.S.C. 552(b)(5), (6),

(7)(A), and (7)(D)) and 10 CFR 9.5(a)(5), (6), (7)(i), and (7)(iv) of the

Commission's regulations. Disclosure of the information would inhibit the

exchange of information during the agency's deliberative process, would

constitute an unwarranted invasion of personal privacy, disclose the identity

of confidential sources, or interfere with an enforcement proceeding. The

nonexempt portions of the records listed on Appendix C will be placed in the

NRC Public Document Room (PDR) in folder F01A-85-777 under your name.

As we indicated in our March 4, 1986 response to you, these records will also

be placed in the Local Public Document Room (LPDR) for Braidwood, which is the

Wilmington Public Library, 201 South Kankakee Street, Wilmington, IL 60481.

The records will be made available to you for your inspection at no charge and

copying for a nominal fee.

Pursuant to 10 CFR 9.9 of the Conunission's regulations, it has been determined

that the information withheld is exempt from production or disclosure, and

that its production or disclosure is contrary to the public interest. The

persons responsible for this denial are the undersigned and Mr. James G.

Keppler, Regional Administrator, NRC Region III.

This denial may be appealed to the Commission's Executive Director for

Operations within 30 days from the receipt of this letter. As provided in
