RESOLUTION NO. 2206 A RESOLUTION ENCOURAGING THE NUCLEAR REGULATORY

" C0hNISSION TO WITHHOLD APPROVAL OF THE PERRY NUCLEAR POWER PLANT OPERATING AT MORE THAN 5%

CAPACITY PENDING REVIEW OF THE EVACUATION PLAN.

WHEREAS, the Police and Fire Chiefs of the City of Geneva have examined the Emergency Evacuation Plan for a nuclear accident at the Perry Nuclear Power Plant, and WHEREAS, the Governor of the State of Ohio has appointed a committee to examine the' adequacy of the Emergency Evacuation Plan, NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Geneva calls upon the Nuclear Regulatory Commission to consider these requests:

SECTION I. That the Perry Nuclear Power Plant not be given -

permission to operate above "5% power" until such time as the Fire-Chief and Chief of Police of the City of Geneva have informed City Council that they are satisfied that the Emergency Evacuation. Plan for the City is reasonably capable of execution, a situation which they currently strongly feel is not the status of the plan.

SECTION II. That the Perry Nuclear Power Plant not be given permission to operate above "5% power" until such time as the com-mittee, appointed by Governor Richard Celeste to investigate the adequacy of the Emergency Evacuation Plan, report a favorable finding >

concerning the status of the plan.

SECTION III. That the Price Anderson Act be amended to eliminate financial limits on all liabilities.

SECTION IV. That this resolution shall be in force and take effect from and.after the earliest period allowed by law.
