I am writin to you In the Matter of the Cleveland Electric Illuminatin Company, et al.g(Perry Nuclear Power P1 ant)) Docket Nos. 50 440 and 50 441;g Request for Action Under C.F.R. 2.206 filed by Petitioners Concerned Citizens of 1.ake, Geauga. and Ashtabula Counties of Ohio.

On behalf of ths State of Ohio, the undersigned has reviewed the Petitioners' filing and has found that many of the recesseendations contained in the filing are meritor10ws and provide an opportunity to enhance the quality of the Cleveland tiectric Illuminating Company's Emercancy Prenaredness Information handbook.

While at this time we do not formally join in the Petitioners' request for action, we did want to make it known to you that we believe that i. enhancement of the Emergency Preparedness

We strongly encourage your thorough review of the recommendations made by the Concerned Citizens and we are anxious to participate with you in improving the information provided to citizens of northeastern Ohio.

in this regard, within the last year. the Severnor of Ohte estaelished an Emergency Ivaeuttien Review Team composed of three cetthet members who are charged with a review of the emergency evecuation plans for the nuclear power plants in Ohio.

In January 1987, the EERT produced a report that made e proadly reaching series of tetelve recommendations on ways to improve our emergency preparedness in the event of a avstear power plant disaster.

Cne of those recommendations went to the issue of public edgcation, the subject of the instant petition. The reccomendations by EERT have been tenerally accepted by all of the certicipants in emergency planning and a series of agreements have been reached for the implementation of the TERT Committee's recommendations.

In addition, to provide for Creater Public participation, the Chairman of the Public Utilities Cossaission of Ohio, at the request of the Governer, established a Citizen's Adyttery Council to advise the state govertsment on matters relating to the public health th1 safety of Chicans that may be affected by the potential hazards of nuclear power plants.

It is my intention to bring the subject of the Concerned Citizens petition before both the Mrking group charged with implementing the EERT recomumendation and the Citizen's Advisory Council with the request that both of these groups seek to find methods to implement the recomendations which the Concerned Citizens have suggested.

In our opinion, improving puelic education concerning appropriate methods of avoiding injur'y from nuclear power plant hasardt is an i

ongoing responsibility. We look forward to working with the Nucleer Regulatory Commission to try to develop reasonable courses of action to enhance public education and minimize risks.

As The Governor has referred your 2.206 filing and cover letter to me.

Locally, we can, in combination with greater oversight of NRC inspection programs, and through focused review of utility company management policies, practices, and organization, develop additional ways to leverage utility company management accountability, as well as NRC inspection and the review prograns to assure the most robust nuclear safety program possible.

It is with this background that I with to respond to your letter of September 21, 1987 to the Governor and the attached 2.206 filing.

N I reviewed your 2.206 filing and find that there are indeed a good number of constructive improvements suggested that will benefit the tone, quality, and substance of the Emergency PreDaredness Infomation Handbook published by the C1eveland Electric Illuminating Company.

Ms. Kline November 12, 1987 Page As I have expressed to those in the business of safety planning, prepared-ness, or maintenance--there is no perfect emergency plan, as there is no risk-free enterprise or human activity.

Planning for a disaster is caly a useful and prudent activity if the plans are tested, and the plans are reviewed and improved.

If we accept a plan without periodically testing the assumptions upon which it was built, and exercise and evaluate its constituent parts, then

in reality we don't have a plan, just the potential for one.

Without passing judgment on the merits of each of the indivioual recommendations that Concerned Citizens make in their 2.206 filing, I think that it would be in the best interest of the citizens of Onio for the State to send a letter of support for your pet; tion to the Director of the Of fice of Nuclear Reactor Regulation of the United States Nuclear Regulatory Commission.

The support for your petition will be premised on the one hand by the generally meritorious qualities of the recommendations made, and on the other by supporting a program of review, redesign and distribution based on the i

existing consensus building oppcrtunities we have with groups such as the Emergency Evacuatinn Review Team working group, and the Citizens Advisory Council for nuclear safety.

I will urge the NRC to give positive review to the suggestions for improvement of the brochure which you make, but we will stop short of endorsing tne total 1ty or snu rumeuy whlvli yvu seck.

Further, 1 intend to request th:t the EERT working group and the Citizen's Advisory Council on Nuclear Safc'.y both review your recommended changes and determine if they can have positive impact in improving public information and safety.

I think that greatest success for implementing your recommendations will come by working with the utility companies, counties, and state representatives who have the clear mandate to create a continually improving, living breathing, emergency evacuation plan.
