20555 RE:
In the Matter of The Cleveland Electric Illuminatino Company, et al.,
Docket.No.50-440 OL.,60-441 OL
Dear Gentlemen:
I am writing to you at the request of Governor Richard P.
Celeste, in reference to the State of Ohio's Petition "or Leave to Intervene in the above referenced matter, filed in Washington on September 4, 1986.
As yet, the Commission has not acted upon this Petition.
On October 14, 1986, the United States Court of Appeals for the Sixth Circuit dissolved their stay order, wherein they had directed that any possible vote on the full-power operation of the Perry Nuclear Power Plant be stayed.
There now remains no legal obstacle to a Commission vote on full-power operation of the Perry Nuclear Power Plant.
The State of Ohio respectfully and urgently requests this Commission to rule upon Ohio's Petition for Leave to Intervene before voting upon the full-power operation of the Perry plant.
The St. ate is seeking a voice in a matter of great safety significance to its citizens.
Respectfully yours, ANTHONY J.
