Dear Mr. Saltzman:

This will supplement the response of the City of Cleveland to your data request of February 21, 1978. Enclosed is a copy of a letter from Mr. George B. Crosby, Executive Director of AMPO to Mr. Richard B. Miller, Executive Vice President of CEI requesting CE1 to provide 80 mW of wheeling capacity for transmission of PASNY power to the City.

CEI has agreed to prepare a transmission agreement which, presum-ably, would be in conformance with the wheeling schedule which CEI has filed with FE RC. CEI's filed wheeling schedule, of course, containe provisions contrary to the Perry and Davis-Besse license conditions. In this regard, the City would note that while Mr. Bingham stated in his letter to you dated March 17,1978, that CEI was willing to amend its tariff filing at FERC to comply in part with the license conditions, CEI has not yet filed such an amendment with the FERC.

Pursuant to the Transmission Service Tariff filed with the FERC on or about January 27. 1978, American Municipal Power of Ohio (AMP-0) is requesting reser-vation of transmission capacity for the wheeling of power and energy from the Power Authority of the State of New York (PASNY) for the accounts of the City of Cleveland. ,

AMP-Ohio Mc urepared a new application to PASNY for a permanent allocation of at least 20 megawatts and possibly as much as 80 megawatts. As part of its application, AMP-Ohio must advise PASNY that it has commitments from PENELEC and CCl to wheel power and energy for AMP-Ohio. Once obtained, AMP-Ohio would sell its entire allocation of PASNY power and energy to the City of Cleveland, Ohio.

PENELEC has agreed to provide wheceling services of up o 80 megawatts of capacity on its own systen from a point of interconne: tion with Niagarn Mohawk Power Corporation at the New York-Pennsylvania border to a point of interconnection between PENELEC and CEI at the Pennsylvania-Ohio boicder.

Therefore AMP-0 is requesting transmission service of up to 80 megawatts over the CEI system from a point of interconnection at the Ohio-Pennsylvania border with PENELEC to a point of interconnection between the City of Cleveland and CEI. All transmission service provided by CEI will be at transmission voltages (132KV and above). The re-

3 Consequently AMP-0 and the City of Cleveland requests an immediate meeting to final-ize this request.
