' Dear Mr.'Berson; The Public Utilities Commission Of Ohio ordered its' -Staff to conduct a comprehensive assessment ~of The Perry Nuclear Power Plant in two phases. Phase I was a Prudence Investigation deal-ing with cost overruns due.to mismanagement. Phase.II is a Cost and--Schedule-analysis on power ascension and is currently under review.-  ;

One:of the major aspects of the Perry Phase II analysis has been in Nuclear Licensing, the review'of NRC reporting requirements and the reports. To date,-this investigation has been limited to analyzing Perry management reference documents-and company personnel on every sequence of power ascension. We need to broaden the perspective of the review. Therefore, the Perry Audit Staff recommended, and received approval from it's management to discuss these issues with NRC Region III. The primary objective will be to solicit and unbiased appraisal of

. power ascension from the NRC's vantage point, independent from Perry Project Management's interpretation.

The Commission Staff requests an interview with your Staff.

-We have several areas of inquiry. The first area centers around the operations performance parameters established by your agency.

Our goal is to judge-the operating companies' effectiveness during power ascension and evaluate how they interpreted safety

' compromises, operational incentives, and other criteria used to measure performance. Secondly we wish to review certain' aspects of Perry's testing procedures, and ultimately commercial operation. The intent is to evaluate the effectiveness of Perrys' Licensing Event Report (LER) mechanisms. We have questions on Design Change Packages and Tech Spec Changes with the intent of comparing these to similar BWR's and industry averages.

- would like to review the off gas " unusual event", and your-perceived poor reporting by the company. If we are'ableLto cover this agenda, it will provide us with a proper perspective of power ascension:and help us to judge the reasonableness-of any deviation-to1the-process.

We propose a meeting some time.in the.last half of August, contingent upon availability of your personnel. We estimate a two day investigation. The first day would entail interviews and the second day for research of documents and any additional interviews deemed necessary, time permitting.
