Dear Mr. Zech:

A proceeding 1.s currently before the Public Utilities Com-mission of Ohio regarding an investigation of the costs asso-ciated with the construction of the Perry Nuclear Power Plant.

Subsequent to the investigation of these costs conducted by the Commission Staff and its retained consultant, the Staff became aware of the fact that the NRC has been in possession of a copy of the so called " Reed Report" since January, 1979. It is that fact which prompted my previous request that officials of the NRC come to Ohio to brief the Staff _and parties involved.in this matter with respect.to the safety related items identified in the Report, which took place yesterday.. At-that time we learned of the various proceedings before the NRC in which the report has been.made an issue and the-NRC's determination in July, 1986, not to release the Report on the basis that it would impair _the agency's ability to obtain similar information in the future.

I appreciate the briefing that was provided-to us regarding the_ safety-related items with respect to the General Electric BWR-6 Mark.III Nuclear Steam Supply System. The Staff of the Commis-sion, however, believes that further disclosure of the. contents of the Reed Report may be of' significance to the outcome =of its prudency. review of the Perry Plant. While, as Chairman of the Ohio Commission, I will only review the. record as It is presented in the proceeding, the~ Staff has requested that;I correspond directly with you on its behalf to request that you provide a copy of the Reed Report to the Staff at this time.

i Specifically, the' Ohio public records law, contained in Section 149.43 of the Ohio Revised Code, applies to the Public Utilities Commission.

Additionally, the Commission is subject to the provisions con- 3 tained in Sections 4901.12 and 4905.07 of the Ohio. Revised Code.

In light of the fact that the proceeding regarding the prudence of construction costs associated with the Perry Plant is ongoing, I would appreciate your most expeditious response to this request. A similar request is being made to the General Electric Company. While I understand that consideration of this request may entail substantial analysis on your part, IIf would you have appreciate a reply no later 5 p.m._on June 16, 1987.
